These Terms and Conditions ("Terms") govern your access to and use of your online account with Canyon Vista Pool Association (the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not create an account or use the Service. If you already have an account and do not agree to the terms, please request a deletion of your account by contacting membership@canyonvistapool.org
ATTENTION PARENTS AND LEGAL GUARDIANS: This Service is designed for use by adults 18 years of age or older. If you are creating an account or providing any information on behalf of a child under 13, you must be their parent or legal guardian and you must provide verifiable consent as outlined in these Terms.
1. Eligibility and Account Creation
Age Requirement: You must be at least 18 years of age to create an account and use this Service. By creating an account, you represent and warrant that you are 18 years of age or older.
Parental/Legal Guardian Responsibility for Minors: If you are a parent or legal guardian and wish to register a child under the age of 18 for pool-related activities or services through this account, you acknowledge and agree that:
You are the parent or legal guardian of any child under 18 whose information you provide.
You are solely responsible for all activities conducted through your account, including those of any children registered under your account.
For any child under the age of 13, you will be required to provide verifiable parental consent before we collect any personal information from them. This consent includes creation of an account where you have represented that you are of at least 18 years of age.
You understand that you have the right to review any personal information collected from your child, request its deletion, and prevent further use or collection of such information.
You agree to ensure that any information provided regarding your child is accurate and kept up-to-date.
Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided is inaccurate, not current, or incomplete.
Account Security: You are responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
2. Use of the Service
Permitted Use: You may use the Service solely for its intended purpose, which includes managing your community pool membership, registering for activities, viewing schedules, and communicating with CVPA.
Prohibited Conduct: You agree not to:
Use the Service for any unlawful purpose or in any way that violates these Terms.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Interfere with or disrupt the operation of the Service or the servers or networks connected to the Service.
Engage in any activity that could harm CVPA, its users, or third parties.
Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service.
Content You Provide: You are solely responsible for any content you upload, post, or transmit through the Service. You agree that you will not upload, post, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
3. Privacy Policy
Data Collection and Use: Data collected by CVPA is used only for maintaining the membership of the pool and protecting the accounts of its users. These actions include verifying the identity of users at check-in, sending communications related to CVPA accounts and performing billing operations as needed. CVPA does not share information with outside parties and access to the membership management system is limited ONLY to employees or representatives of the corporation as defined in the bylaws.
COPPA Compliance: We are committed to complying with the Children's Online Privacy Protection Act ("COPPA"). As such:
We do not knowingly collect personal information online from children under 13 without verifiable parental consent.
If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take reasonable steps to delete that information promptly.
Parents/legal guardians have the right to review their child's personal information collected through the Service, request its deletion, and refuse to permit further collection or use of such information. To request this, please email membership@canyonvistapool.org
